Terms of Use

These Terms of Use ("Terms") govern your access to and use of bot2site, a website creation service operated via Telegram bot. Please read them carefully.

1. About bot2site

1.1 Service Description

bot2site is a SaaS (Software-as-a-Service) platform that enables you to create, edit, and publish websites by conversing with our Telegram bot. The service includes:

• Website builder: Interactive bot-based website creation by selecting templates and answering questions
• Website hosting: We host your website on our servers located in the EU (Germany, Hetzner)
• Optional custom domain: Connect your own domain name with DNS verification assistance
• SSL/TLS certificates: Automatic HTTPS encryption for your websites
• Content management: Edit and update your website content via Telegram
• Template library: Pre-designed templates for various website types

2. Eligibility and Account Registration

2.1 Age Requirement

You must be at least 16 years old to use bot2site, in accordance with Art. 8 GDPR and Estonian consumer law. If you are under 16, you may only use the service with verifiable parental or legal guardian consent.

2.2 Authority to Contract

If you register on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.

2.3 Account Accuracy

You must provide accurate, current, and complete information during registration and keep your account information up to date.

2.4 Account Security

You are solely responsible for:

• Maintaining the confidentiality of your Telegram account credentials
• All activities that occur under your account
• Any payment method associated with your account
• Notifying us immediately of any unauthorized use at support@bot2site.com

3. User Content and Intellectual Property

3.1 Your Content Rights

You retain all ownership rights to any content, text, images, logos, and materials you provide or create through bot2site ("Your Content").

3.2 License Grant to Us

By using bot2site, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and transmit Your Content solely for the purpose of operating and providing the service to you.

This license terminates when you delete Your Content or close your account, except for:

• Content that has been shared with others and they have not deleted
• Content retained in backups for up to 30 days
• Content we must retain for legal compliance

3.3 Your Responsibilities

You represent and warrant that Your Content:

• Does not violate any third-party intellectual property rights (copyright, trademark, patent, trade secret)
• Does not contain illegal, harmful, defamatory, obscene, or abusive material
• Does not violate any applicable law or regulation
• Does not contain malware, viruses, or malicious code
• Does not infringe on privacy rights or contain personal data of others without consent
• Does not constitute spam, phishing, or fraudulent content

3.4 Auto-Generated Legal Pages

bot2site may generate legal pages (e.g., Impressum, Privacy Policy, Legal Notice) from templates based on information you provide. These templates are provided "as is" and do not constitute legal advice. You are solely responsible for ensuring the accuracy, completeness, and legal compliance of such content for your jurisdiction.

3.5 Content Moderation

We reserve the right to remove, suspend, or refuse to publish Your Content if it violates these Terms, applicable law, or our content policies, in accordance with the EU Digital Services Act. We will notify you of content removal with reasons, except where legally prohibited.

3.6 Our Intellectual Property

The bot2site platform, including all software, templates, designs, logos, text, graphics, user interface, and underlying technology, remains the exclusive property of Valnovo OÜ. These Terms grant you only a limited, non-exclusive, non-transferable right to use the service for its intended purpose. You may not:

• Copy, modify, or create derivative works of our platform
• Reverse engineer, decompile, or disassemble our software
• Remove or alter any proprietary notices
• Use our trademarks without prior written permission

4. Pricing, Billing, and Subscriptions

4.1 Free and Premium Plans

bot2site offers:

• Free plan: Basic website creation and hosting with bot2site subdomain
• Premium plan: Custom domain support, additional features, and enhanced support

4.2 Subscription Terms

Premium subscriptions are billed via Stripe (card payments) or Telegram Stars (in-app payments), depending on the payment method you choose. Plans may be monthly, yearly, or multi-year. Subscriptions renew automatically until cancelled. By subscribing, you authorize us to charge your payment method on each billing cycle. For Stripe: billing is monthly in advance. For Telegram Stars: billing follows the plan period you selected (monthly, yearly, or 2-year).

4.3 Pricing and Currency

All prices are displayed in EUR (€) and include applicable VAT where required by law. Estonian VAT (24% from July 2025) applies to Estonian consumers. For EU consumers in other countries, VAT may apply at your local rate if we exceed the €10,000 EU-wide sales threshold.

4.4 Price Changes

We reserve the right to change our prices. For existing subscribers, we will provide at least 30 days' advance notice of any price increase via email or Telegram message. The new price will apply from your next billing cycle. You may cancel before the new price takes effect.

4.5 Payment Failures

If a payment fails (e.g., expired card, insufficient funds, or insufficient Telegram Stars balance), we will notify you and attempt to collect payment again. If payment cannot be collected within 7 days, your Premium features may be suspended until payment is successful. Your website will remain accessible but you cannot make changes or use Premium features.

4.6 Chargebacks and Payment Disputes

If you dispute a charge with your bank or payment provider (chargeback) or request a refund through Telegram for a payment you authorized, without a valid legal basis (e.g., fraud, duplicate charge), we may suspend or terminate your account and access to Premium features. You remain liable for the disputed amount. We reserve the right to pursue collection of any unpaid fees.

4.7 Taxes

All prices exclude taxes unless otherwise stated. You are responsible for any applicable taxes (VAT, sales tax, etc.) based on your location. We will add applicable taxes to your invoice where required by law.

4.8 Custom Domain — Registration, Connection and Transfer

bot2site offers two distinct options for connecting a custom domain to your website. The selected option determines the allocation of responsibilities between you and bot2site.

4.8.1 Option A — Connect Your Own Existing Domain ("I already have a domain")

If you already own a domain, you may connect it to your bot2site website by:

1. Entering the TXT verification record provided by bot2site into your DNS settings
2. Adding the required A record (pointing to our server IP address)
3. Adding the required CNAME record as instructed

In this case:

• You are solely responsible for correctly entering and maintaining DNS records at your domain registrar or DNS provider
• You remain solely responsible for domain ownership, renewal, expiration management, and registrar account access
• bot2site provides technical instructions and verifies DNS records from our infrastructure, but we are not responsible for misconfigurations made at your registrar or DNS provider
• Domain connection typically completes within 1–4 hours after correct DNS configuration but may take up to 48 hours due to global DNS propagation; this timeframe is an estimate and does not constitute a contractual guarantee

bot2site is not liable for downtime, resolution failures, SSL issuance delays, or interruptions caused by third-party registrars, DNS providers, registry operators, internet infrastructure, or certificate authorities beyond our control.

4.8.2 Option B — Register a New Domain Through bot2site ("I need a domain")

If you do not yet own a domain, bot2site may search for and register an available domain on your behalf using the registrant data you provide.

You will be required to submit:

• Full legal name
• Address
• Email address
• Any additional information required by the relevant domain registry (WHOIS / registrant data)

In this case:

• bot2site acts as a technical intermediary with a domain registrar partner
• The domain is registered in your name and under your registrant data
• The domain remains your property
• You are solely responsible for the accuracy, legality, and completeness of the registrant data provided
• False, misleading, or incomplete registrant data may result in domain suspension, deletion, or registry action

The annual domain registration fee is included in your subscription up to approximately 15 USD (or equivalent) per year, depending on the TLD and subject to exclusions in Section 4.8.6.

bot2site does not perform comprehensive trademark clearance checks and does not guarantee that the domain does not infringe third-party rights.

By authorizing bot2site to register a domain on your behalf, you confirm that:

• The provided registrant data is accurate and legally valid
• You are authorized to register and use the domain
• The domain does not infringe third-party intellectual property rights
• You accept the terms and policies of the relevant domain registry (e.g., DENIC for .de, EURid for .eu, Verisign for .com)

4.8.3 Domain Renewal and Expiration

Domain registration under Option B is valid for one year unless otherwise stated.

If:

• Your subscription is terminated
• Payment fails
• You cancel the service
• Or you do not renew in time

bot2site is not obligated to renew the domain.

The domain may expire, enter a redemption period, incur additional recovery fees, or become available for registration by third parties. bot2site is not responsible for losses resulting from domain expiration due to non-payment or subscription termination.

4.8.4 Domain Transfer to Customer

You may request a transfer of your domain to another registrar or to direct registrar management under your control.

Such transfer may require:

• Identity verification
• Administrative processing
• Registrar-side technical steps
• Provision of an authorization code (Auth-Code)

A transfer processing fee of 49 EUR applies per domain.

The transfer fee covers administrative handling and coordination but does not include potential registrar transfer fees charged by third parties.

Transfer processing may take several business days depending on registry and registrar policies.

bot2site is not responsible for delays caused by registry locks, transfer restrictions, or registrar-side limitations.

4.8.5 Right to Refuse, Delay, Suspend or Revoke Domain Connection

bot2site reserves the right, at its sole discretion, to refuse, delay, suspend, or revoke domain connection or registration in the following circumstances:

• The domain infringes or appears to infringe registered trademarks or third-party rights
• The domain is associated with illegal, abusive, misleading, fraudulent, or prohibited content
• The domain is blacklisted or flagged by ICANN, registry operators, security services, or law enforcement
• The domain violates registry rules or applicable laws
• The domain cannot be technically connected due to DNS incompatibility, registrar restrictions, or infrastructure limitations
• The domain conflicts with bot2site's own domains, trademarks, or technical architecture
• The registrant data provided is false, incomplete, unverifiable, or suspicious
• There are reasonable grounds to believe the domain will be used in violation of Section 7 (Prohibited Uses)

Where legally permitted, we will inform you of the reason for refusal. Refund eligibility is governed by Section 5.

4.8.6 Supported TLDs and Exclusions

Supported TLDs include, but are not limited to:

• Generic: .com, .net, .org, .info, .biz, .app, .xyz, .online, .site, .tech
• Europe: .de, .eu, .fr, .it, .es, .nl, .be, .at, .ch, .pl, .cz, .se, .fi, .lt, .pt, .sk, .hu, .ro, .bg, .gr, .dk, .no, .ie, .ee, .lv, .hr, .si, .rs, .uk, .co.uk
• Americas & other: .us, .ca, .mx, .co, .ar, .br, .cl, .pe, .uy, .ec, .au, .nz, .in
• CIS / Eastern Europe: .ru, .by, .ua, .kz, .am, .ge, .md, .az, .com.ua, .net.ua, .org.ua

Premium, high-value, short, reserved, auction-based, or specialty domains exceeding the included annual value are excluded from subscription coverage. Such domains may require additional payment or independent registration by you.

bot2site is not obligated to support TLDs outside the listed extensions.

4.8.7 SSL Certificates and Technical Infrastructure

Custom domains are automatically secured using SSL certificates issued via third-party certificate authorities.

bot2site is not liable for delays, refusals, revocations, or technical issues caused by certificate authorities or registry policies.

If a custom domain is disconnected, suspended, or expires, the website may revert to a bot2site subdomain or become temporarily inaccessible.

5. Right of Withdrawal and Cancellation

5.1 14-Day Cooling-Off Period (EU Consumers)

As an EU consumer, you have the right to withdraw from your Premium subscription within 14 days of purchase without providing any reason, in accordance with EU Consumer Rights Directive 2011/83/EU.

Important exception: If you request that we begin providing the Premium service (enabling custom domain, SSL, etc.) immediately during the 14-day period, you expressly waive your right of withdrawal for that service, as it is fully performed digital content under Art. 16(m) of Directive 2011/83/EU.

How to withdraw: Send a clear statement of your decision to withdraw to support@bot2site.com within 14 days of subscription purchase. You may use the model withdrawal form below.

Refunds: If you withdraw within 14 days and have not expressly waived your right, we will refund all payments within 14 days using the same payment method you used.

Proportional charges: If you expressly requested immediate service provision and used the Premium features during the 14-day period, we may charge a proportional amount for the service already provided.

5.2 Cancellation Anytime

You may cancel your Premium subscription at any time by:

• Emailing support@bot2site.com
• Canceling through your Stripe customer portal (if you pay via Stripe)
• Using the subscription management options in the bot (if you pay via Telegram Stars)

Effect of cancellation: Your access to Premium features continues until the end of your current paid billing period. No partial refunds are provided for the unused portion of a billing cycle, except where mandatory consumer law grants you such rights (e.g., Estonia's consumer protection law).

5.3 EU Data Act Cancellation Rights (for Business Customers)

For business customers in the EU, the EU Data Act (Regulation 2023/2854) grants the right to cancel SaaS subscriptions for data processing services with a maximum 2-month notice period, effective from September 12, 2025. This applies to multi-year contracts. Early termination penalties must be reasonable and transparent. From January 12, 2027, early termination fees are prohibited.

For bot2site, we do not impose notice periods or early termination fees, so you can cancel immediately at any time.

5.4 Model Withdrawal Form (EU Consumers)

6. Custom Domains and SSL/TLS

6.1 Domain Ownership

You retain full ownership of any custom domain you connect to bot2site. We do not claim any rights to your domain.

6.2 DNS Configuration

We provide instructions and assistance with DNS verification (CNAME, A records, etc.). You are responsible for:

• Correctly configuring DNS settings at your domain registrar
• Maintaining domain registration and renewal
• Ensuring your domain registrar allows the required DNS records

6.3 SSL/TLS Certificates

We automatically provision and renew Let's Encrypt SSL/TLS certificates for your custom domains. You are responsible for ensuring DNS records are correctly configured, as incorrect DNS may prevent certificate issuance or renewal.

6.4 Domain-Related Downtime

We are not liable for downtime or inaccessibility caused by:

• Incorrect DNS configuration
• Domain expiration or suspension by your registrar
• DNS propagation delays (typically 24-48 hours)
• Third-party registrar or DNS provider issues

7. Prohibited Uses

You agree not to use bot2site to:

• Publish, distribute, or host illegal content (child sexual abuse material, terrorist content, copyright-infringing material, etc.)
• Engage in spam, phishing, or fraudulent activities
• Distribute malware, viruses, or malicious code
• Violate intellectual property rights of third parties
• Harass, threaten, or defame others
• Impersonate any person or entity
• Attempt to reverse engineer, decompile, or hack the service
• Overload, disrupt, or attack our infrastructure (DDoS attacks, brute force attempts, etc.)
• Scrape or harvest user data without authorization
• Use the service for any unlawful purpose
• Violate any applicable law or regulation, including GDPR, ePrivacy Directive, and national laws

Enforcement: We may suspend or terminate your account immediately if you violate these prohibitions, in accordance with the Digital Services Act.

8. Service Availability and Support

8.1 "As Is" Service

bot2site is provided on an "as is" and "as available" basis without warranties of any kind. While we strive for high availability and reliability, we do not guarantee uninterrupted, error-free, or secure operation.

8.2 Scheduled Maintenance

We may perform scheduled maintenance, which may result in temporary service unavailability. We will provide advance notice where reasonably possible via:

• Telegram announcement in the bot
• Email notification

8.3 Emergency Maintenance

We reserve the right to perform emergency maintenance without prior notice to address security vulnerabilities, critical bugs, or system failures.

8.4 Uptime Target

We aim for 99.5% uptime on a monthly basis, excluding scheduled maintenance. This is a target, not a guarantee.

8.5 Support

• Free plan users: Email support at support@bot2site.com with best-effort response within 3-5 business days
• Premium users: Priority email support with response within 1-2 business days

Support is available in English, German, and Russian.

9. Liability and Disclaimers

9.1 Limitation of Liability

To the maximum extent permitted by law, our aggregate liability to you for any claims arising from or related to these Terms or your use of bot2site is limited to the fees you paid to us during the 12 months immediately preceding the claim.

9.2 Types of Damages Excluded

We are not liable for any:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, goodwill, or business opportunities
• Costs of procuring substitute services
• Damages arising from Your Content or your violation of these Terms
• Damages caused by third parties (e.g., Telegram downtime, Telegram Stars payment issues, Stripe payment issues, domain registrars)

9.3 Exceptions to Limitations

We do not exclude or limit liability where it would be unlawful to do so under Estonian or EU law, including for:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Willful misconduct or gross negligence
• Consumer rights under Estonian Consumer Protection Act or EU consumer directives
• Data protection violations under GDPR

9.4 Force Majeure

We are not liable for any failure or delay in performance due to causes beyond our reasonable control, including:

• Natural disasters (floods, earthquakes, fires)
• Acts of war, terrorism, or civil unrest
• Government actions, sanctions, or legal restrictions
• Internet or telecommunications failures
• Third-party service provider failures (Hetzner, Telegram, Telegram Stars, Stripe)
• Pandemics or public health emergencies

9.5 Your Content

You are solely responsible for Your Content and any consequences of publishing it. We are not liable for:

• Any losses arising from Your Content
• Copyright, trademark, or other IP infringement claims
• Defamation or privacy violations
• Illegal content you publish

10. Indemnification

You agree to indemnify, defend, and hold harmless Valnovo OÜ, its officers, employees, contractors, and agents from any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from:

• Your use or misuse of bot2site
• Your Content or your violation of intellectual property rights
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Any third-party claims related to your website or content

11. Account Termination

11.1 Termination by You

You may terminate your account at any time by:

• Using the /deleteaccount command in the bot
• Emailing support@bot2site.com

Effect: Upon termination, your Premium subscription (if any) will be canceled, and your website will be taken offline. You may export/download your content before deletion.

11.2 Termination by Us

We may suspend or terminate your account and access to bot2site immediately if:

• You materially breach these Terms
• You engage in prohibited uses (Section 7)
• We are required to do so by law or court order
• You fail to pay fees after reasonable notice
• We detect fraudulent, abusive, or illegal activity
• We reasonably believe your account poses a security risk

Notice: Where legally required and reasonably practicable, we will provide advance notice and an opportunity to remedy the breach before termination.

11.3 Effect of Termination

Upon termination:

• Your access to bot2site will immediately cease
• Your website will be taken offline within 24 hours
• Your Content will be deleted after 30 days (backup retention period)
• No refunds will be provided for partial billing periods, except where required by law
• Sections that by their nature should survive (Liability, Indemnification, Intellectual Property) will continue to apply

11.4 Data Export

Before termination, you may request a copy of Your Content in JSON or CSV format. Email support@bot2site.com at least 7 days before account closure.

12. Privacy and Data Protection

Your use of bot2site is also governed by our Privacy Policy and our Cookie Policy.

Key points:

• We process your personal data in accordance with GDPR and Estonian Personal Data Protection Act
• We are the data controller for your account data
• Telegram is an independent data controller for data you share via their platform
• Your website data is hosted in the EU (Germany, Hetzner)
• You can exercise your GDPR rights (access, rectification, erasure, etc.) at any time
• Business customers (B2B): Data Processing Agreements (DPAs) are available upon request at support@bot2site.com

13. Changes to These Terms

13.1 Right to Modify

We reserve the right to update or modify these Terms at any time.

13.2 Notice of Changes

• Material changes (e.g., pricing, liability, termination): We will notify you at least 30 days in advance via email or Telegram message
• Minor changes (e.g., clarifications, formatting): We will update the "Last updated" date at the top of this document

13.3 Acceptance of Changes

If you continue to use bot2site after the effective date of the changes, you agree to be bound by the updated Terms. If you do not agree, you must stop using the service and may cancel your account.

13.4 Version History

Previous versions of these Terms are available upon request at support@bot2site.com.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Estonia, without regard to conflict of law principles.

14.2 Jurisdiction (Business Customers)

For business customers (B2B), any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Tallinn, Estonia.

14.3 Consumer Protection (B2C)

If you are an EU consumer (individual acting for non-commercial purposes), this choice of law and jurisdiction does not deprive you of the protection afforded by mandatory consumer protection laws in your country of residence. You may also bring proceedings in the courts of your country of residence. For consumers in Germany, the requirements of § 312g BGB (distance contracts) and applicable German consumer law apply where mandatory.

14.4 Alternative Dispute Resolution

For EU consumers: Before going to court, you may use the EU Online Dispute Resolution (ODR) platform: ec.europa.eu/consumers/odr

For Estonian consumers: You may also contact the Estonian Consumer Disputes Committee (Tarbijavaidluste Komisjon) for free mediation: komisjon.ee/en

14.5 Small Claims

Nothing in these Terms prevents you from bringing a claim in a small claims court of competent jurisdiction.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Valnovo OÜ regarding bot2site.

15.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms to any affiliate or successor entity.

15.5 No Agency

These Terms do not create any agency, partnership, joint venture, or employment relationship between you and Valnovo OÜ.

15.6 Notices

All notices to you will be sent to the email address or Telegram account associated with your bot2site account. All notices to us must be sent to support@bot2site.com.

15.7 Language

These Terms are provided in English. Translations may be available in other languages (e.g., German). In case of conflict between the English version and any translation, the English version prevails. Additional language versions may be added in the future.
